On 8 September 2026, the text of the draft bill amending the Civil Code and the Code of Civil Procedure (“Draft”) was published on the website of the Government Legislation Centre. The Draft aims to implement Directive (EU) 2024/2853 of the European Parliament and of the Council of 23 October 2024 on liability for defective products (“PLD”) in Poland.
Also on 8 September 2026, public consultations, discussions, and the opinion process regarding the Draft began.
For the next 14 days, until 22 September 2026, interested parties may submit comments on the drafted provisions. The deadline for submitting comments as part of the public consultation has been shortened due to the urgent need to implement the PLD provisions – the implementation deadline is 9 December 2026.
This is an important stage of work for businesses whose activities may involve product liability, especially producers, importers and distributors.
