The objectives of a draft bill amending the Polish Civil Code and Code of Civil Procedure have been published in the legislative work programme of the Council of Ministers. This is another step in the process of implementing Directive (EU) 2024/2853 on liability for defective products (PLD) in Poland.
The new provisions will significantly change the product liability regime. According to the published objectives, the definition of a product will be expanded to include, among other things, software. The circle of potentially liable parties will also be broadened.
The upcoming changes are particularly relevant for producers, importers, distributors, software providers and other parties involved in making products available on the EU market.
The transposition deadline for the PLD is 9 December 2026.
